War Crimes Case Filed in Germany

A human rights group in Berlin, Germany, has filed a criminal complaint against the architects of the George W. Bush administration’s torture program. The European Center for Constitutional and Human Rights has accused former Bush administration officials, including CIA Director George Tenet and Defense Secretary Donald Rumsfeld, of war crimes, and called for an immediate investigation by a German prosecutor. The move follows the release of a Senate report on CIA torture which includes the case of a German citizen, Khalid El-Masri, who was captured by CIA agents in 2004 due to mistaken identity and tortured at a secret prison in Afghanistan. So far, no one involved in the CIA torture program has been charged with a crime — except the whistleblower John Kiriakou, who exposed it. We speak to Michael Ratner, president emeritus of the Center for Constitutional Rights and chairman of the European Center for Constitutional and Human Rights, and longtime defense attorney Martin Garbus.

As the United States opens talks with Cuba aimed at restoring full diplomatic relations and has released the remaining members of the Cuban Five, we feature a Democracy Now! exclusive interview with the first freed member of the group. In this October 2013 interview René González, speaks out after a 13-year imprisonment in the United States. Scroll down to read the complete transcript of the interview.

Today Cuba released Alan Gross, a subcontractor for U.S. Agency for International Development, after five years in prison, while the United States freed the three remaining members of the Cuban Five — Gerardo Hernandez, Antonio Guerrero and Ramon Labañino. The five Cuban intelligence agents were arrested in the United States in 1998 and convicted of conspiracy to commit espionage. They say they were not spying on the United States, but rather trying to monitor violent right-wing Cuban exile groups responsible for attacks inside Cuba. In Cuba, the five are seen as national heroes. González was released in October 2011 and returned to Cuba in April. Joining us from Havana, González discusses why he came to the United States to spy on Cuban exiles, his arrest, and the four other members of the Cuban Five who remain in jail.

Two months after the United States began airstrikes in Iraq that then expanded to Syria, the Islamic State remains in control of most of the territory it has seized — and now threatens to capture the Syrian town of Kobani, just six miles from the Turkish border. If Kobani were to fall to the Islamic State, the group would be in control of more than half of Syria’s border with Turkey. "If Kobani does fall, this will be a symptom of a massive military failure," says Patrick Cockburn, Middle East correspondent for The Independent. "And it’s not just in Syria that this is happening, [but] in Iraq as well."

As ISIS continues to make advances in the face of U.S.-led airstrikes, we are joined by Ghaith Abdul-Ahad, an Iraqi journalist working with The Guardian who recently embedded with Shia militias around Baghdad fighting the Sunnis. "The war that ISIS is raging on the Iraqi government is a coalition of many different tiny little wars," Abdul-Ahad says. "Everyone has his own grievances against the central government of Iraq, yet ISIS has managed to include them all under a single umbrella." Abdul-Ahad argues that any attempt by the United States and its allies to fight the Islamic State as a monolithic organization is bound to fail. "By sending more weapons, sending more money, you’re just adding to the fuel of the war. You need a social contract with the Sunnis of Iraq." In the new book, "Back Channel to Cuba: The Hidden History of Negotiations between Washington and Havana," authors Peter Kornbluh and William LeoGrande use recently declassified documents to expose the secret history of dialogue between the United States and Cuba. Among the revelations are details of how then-U.S. Secretary of State Henry Kissinger considered launching airstrikes against Cuba after Fidel Castro sent troops to support independence fighters in Angola in 1976. In the years that followed, top-secret U.S. emissaries, including former President Jimmy Carter and Nobel Prize-winning author Gabriel García Márquez, worked to normalize relations with Cuba. The book’s release comes as Cuban leader Raúl Castro is set to participate for the first time in next year’s Summit of the Americas in Panama. Cuba recently denounced the Obama administration for extending the more than 50-year embargo for another year in a little-noticed move in September.

A week after President Obama vowed not to send ground troops into Iraq to fight the Islamic State, Gen. Martin Dempsey, chair of the Joint Chiefs of Staff, admitted ground troops may be needed. “If there are threats to the U.S., I would of course go back to the president and make a recommendation that may include the use of U.S. military ground forces,” Dempsey told the Senate Armed Services Committee on Tuesday. Conflicts of Interest Exposed for TV Guests Backing Military Action
A new report finds many talking heads who have been fanning the flames of war in the news media have ties to Pentagon contractors. Reporting for The Nation, Lee Fang details how television analysts including retired generals Jack Keane and Anthony Zinni and former Department of Homeland Security official Frances Townsend have appeared on television recently, but their ties to military contractors were not disclosed. Fang writes many of these commentators "have skin in the game as paid directors and advisers to some of the largest military contractors in the world." Keane, for example, is a special adviser to Academi, the contractor formerly known as Blackwater, and a board member to military manufacturer General Dynamics. He is also a "venture partner" to SCP Partners, an investment firm that works with defense contractors.

The Untold Story of the Shejaiya Massacre in Gaza:
A Former Israel Soldier Speaks Out

On July 20, at least 90 Palestinians and 13 Israeli soldiers were killed in the Gaza City neighborhood of Shejaiya. Days later, former Israeli soldier Eran Efrati was arrested by Israel after he posted details about the massacre based on interviews he conducted with Israeli soldiers who were there. Today he speaks out about what he learned and talks about the killing of 23-year-old Salem Khaleel Shamaly. Activists with the International Solidarity Movement posted a video on YouTube showing the fatal shooting of an unarmed Palestinian civilian during the massacre. Family members later stumbled onto the video and identified the man as Shamaly. In the video, Shamaly is seen lying on the ground, apparently wounded by an unseen sniper. As Shamaly tries to get to his feet, two more shots ring out, and he stops moving. Efrati interviewed three of the Israeli soldiers who witnessed the killing of Salem Khaleel Shamaly. His sources within the Israeli Defense Forces reportedly informed him soldiers were deliberately targeting civilians as "punishment" and "retribution" for the deaths of fellow soldiers in their units. Efrati is a former Israeli combat soldier turned anti-occupation activist and investigative researcher.

Amidst talk of a potential ceasefire, the Palestinian death toll has passed 815 in Israel’s relentless bombings of the Gaza Strip. On Thursday, at least 16 civilians died and more than 200 were wounded when a United Nations shelter was bombed in the Gazan area of Beit Hanoun. Palestinian officials have blamed Israeli tank shelling, while Israel has suggested militant rockets were at fault. Reporting from Gaza City, Democracy Now! correspondent Sharif Abdel Kouddous describes visiting the morgue where bodies are being taken, as well as a children’s hospital in northern Gaza that was severely damaged Thursday in a nearby air strike. "If the ceasefire falls apart, then we can only imagine that an escalation of the ground offensive — that’s what Israel has declared — will be in the cards," Kouddous says. "We are looking at a very grave humanitarian crisis."

At least 16 people were killed and more than 200 injured Thursday when a school used as a United Nations shelter came under fire in Gaza. Palestinian families displaced by the assault had reportedly gathered to move to a safer area when the school was hit. Palestinian officials have blamed Israeli tank shelling, while Israel has suggested militant rockets were at fault. The United Nations Relief and Works Agency for Palestine Refugees (UNRWA) has declined to directly accuse Israel, but says it gave the school’s coordinates to the Israeli army numerous times. "Within Gaza, there is no safe place," says Christopher Gunness, UNRWA spokesperson. "If the parties to this conflict have shown themselves callous enough to be able to hit a clearly designated, clearly marked U.N. compound where hundreds of people have come to take sanctuary, we cannot guarantee anymore the safety of our installations." Gunness says the number of people now seeking shelter amidst the violence has swelled to 150,000.

srael maybe committing war crimes in Gaza, the UN High Commissioner for Human Rights says. Speaking in Geneva, Navi Pillay said house demolitions and the killing of children raise the "strong possibility" that Israel is violating international law.

Opening an emergency debate at the UN Human Rights Council in Geneva, she citied cases of Israeli air strikes and shelling hitting houses and hospitals in the coastal enclave: "These are just a few examples where there seems to be a strong possibility that international humanitarian law has been violated, in a manner that could amount to war crimes,” she said.

She hit out at both sides concerning their conduct during the conflict, which is now in its 16th day, having started on July 8. Some 643 Palestinians, many of them children and civilians have died in the conflict, including a seven-year-old hit by a shell in southern Gaza early on Wednesday, Reuters reports.

As the Israeli assault on Gaza enters its third week, a new push is underway for an internationally brokered ceasefire. Speaking earlier today, Israeli Justice Minister Tzipi Livni said there is "no real hope" of an immediate halt to the fighting because Hamas’ conditions are too far from those of Israel, the United States and Egypt. Hamas’ demands have centered on an end to the Israeli blockade of Gaza and the release of its prisoners. The seven-year siege has crippled the economy, civilian infrastructure and water supplies. In Gaza, unemployment tops 40 percent, and almost 80 percent rely on humanitarian aid. The United Nations has warned Gaza will no longer be livable by 2020 unless urgent steps are taken. The last ceasefire in November 2012 was supposed to ease the blockade, but Israel only intensified it. With Hamas vowing to continue fighting against what it calls a "slow death," a new ceasefire largely hinges on whether the United States and others will pressure Israel to reverse its stance. We are joined from Tel Aviv by Israeli journalist Gideon Levy. In a recent piece for Ha’aretz, Levy writes: "[Hamas’] conditions are civilian; the means of achieving them are military, violent and criminal. But the (bitter) truth is that when Gaza is not firing rockets at Israel, nobody cares about it. ... While many trace the Israeli assault on Gaza to the series of events that began with the kidnapping and subsequent murder of three teenage Israelis in the occupied West Bank, we look at how the crisis’ immediate cause has been all but ignored. In a recent article for The New York Times, "How the West Chose War in Gaza," Nathan Thrall, senior analyst at International Crisis Group, argues the roots of the current violence lie in Israeli, U.S. and European efforts to undermine the Palestinian unity government, which Hamas joined earlier this year. Isolated by its opposition to the Assad regime in Syria and a rift with the military government in Egypt, Hamas reconciled with the West Bank-based Palestinian Authority in the hopes a unity deal could help ease the crippling blockade of Gaza and help pay the salaries of thousands of its civil servants. But the United States and European Union helped Israel maintain the blockade of Gaza while denying payments to the Hamas employees. "Plan A for Hamas out of the predicament it and Gaza found themselves in was reconciliation," Thrall says. "That was thwarted — so Plan B is the crisis we’re dealing with today."

Agency Secretly Built Cuban Twitter Program to Fuel Anti-Castro Protests

"U.S. Secretly Created 'Cuban Twitter' to Stir Unrest." That is the name of an explosive new article by the Associated Press detailing how the U.S. Agency for International Development (USAID) created a fake Twitter program to undermine the Cuban government. The communications network was called "ZunZuneo" — slang for a Cuban hummingbird’s tweet. It was reportedly built with secret shell companies financed through foreign banks. According to AP, the United States planned to use the platform to spread political content that might trigger a Cuban Spring, or, as one USAID document put it, "renegotiate the balance of power between the state and society." We speak to Peter Kornbluh, director of the Cuba Documentation Project at the National Security Archive. He recently wrote an article in Foreign Policy called "Our Man in Havana: Was USAID Planning to Overthrow Castro?"
